WHAT IS NEGLIGENCE
The legal term negligence is defined as the failure of someone to adhere to a reasonable standard of care toward another individual, or acting in a way that could be considered unreasonable in which another person is subject to increased probability of injury. It is important to note that negligent acts do not include civil damages for assault, or battery, or sexual abuse. These are "intentional" torts, where generally the acts go to the actor's purposefulness in causing the injury. Negligence is a lower threshold than intentional . . . Think of negligence as sort of a legal way of saying "they should have know better." Knew better than to run a stop sign, knew better that to not fix that loose step, knew better than to not clean up the spill on the floor . . . these kinds of actions are negligent.
DO I HAVE A CASE FOR DAMAGES CAUSED BY SOMEONE'S NEGLIGENCE
In order to prove that you should be awarded just compensation due to another individual's negligent behavior, you must be able to show that:
- The "negligent party" owed a legally recognized duty of care to the injured party
- The "negligent party" acted or failed to act in a way that would prevent a breach of the duty owed
- The damages sustained by the injured party were directly caused by the negligence
