THE MCMILLIAN LAW FIRM - COMPASSIONATE AND AGGRESSIVE LEGAL REPRESENTATION FOR ACCIDENT VICTIMS OF CHARLESTON, SC AND SUMMERVILLE, SC

It doesn't take very long during the initial car accident or personal injury consultation for the client to ask "the question" . . . How much is my case worth. Considering that general premise, one of the more common scenarios that I am faced with involves specifically "How much is my broken leg case worth?" This very direct question often comes from genuinely injured clients who swallow their personal pride and ask that question simply because the medical bills and doctor's bills are starting to roll in and the insurance company has dug in deep and is giving the injured client the run around.

HOW DOES SOUTH CAROLINA LAW ADDRESS MY BROKEN LEG / FRACTURED LEG INJURY?

When I have this specific conversation about broken leg / fractured leg injuries with clients, I always implore that my job as your attorney is the apply the facts to the well established law and history of jury verdicts that have addressed these types of injuries. Great lawyers, especially great car accident and injury lawyers, know that cases with serious injuries like broken legs are driven by the facts and the law Facts drive cases, cases drive results, and results are the product of the wisdom of our neighbors in Charleston, Berkeley, and Dorchester County who serve on juries that hear these cases. Giant jury awards are not the product of fancy lawyer tricks, they are the result of decent people like you who bring us cases that deserve their just due whether through settlement or trial. Do you need a well trained lawyer? Of course you do, our job primarily is to assert and preserve all your legals right, make sure those rights are not waived or abused by the insurance company, and insure that we help you navigate the formality and hurdles in the court system. Remember, the facts of the case are the most important factor in any personal injury case. With that in mind, we will discuss how broken leg injuries differ from other types of personal injury cases.

THE ANATOMY OF A BROKEN LEG INJURY

The leg is made up of three major bones - the femur, the tibula and the fibula. The femur is the large upper leg bone that is commonly referred to as the thigh. The tibula and the fibula are smaller bones that comprise the lower leg.

  • TIBIAL AND FIBULAR FRACTURES IN CAR ACCIDENTS

the injury known as a tibial plateau fracture occurs just below the knee and can involve the cartilage as well. Early onset treatments and physical therapy is absolutely necessary to avoid the onset of arthritis.

An compound fracture (also known as an open fracture) can be the most painful and difficult to type of fracture to treat and heal. Compound fractures are simply those fractures where there is a complete break of the bone. The most common and medically necessary treatment for a compound fracture of the tibia or fibula is surgery. Compound fractures also commonly pierce the skin, therefore bacteria can infect the would, increasing the danger to the patient and the potential recovery time.

  • PATELLAR FRACTURES IN CAR ACCIDENTS

The patella is in laymen's terms the kneecap. The patellar bone that makes up the knee cap can fracture just like any of the three major leg bones. Less serious patellar fractures where the patient can move their knee still often requires air casting or short term immobilization but can still allow for the injured client to avoid surgery with proper healing time. The more serious knee fractures where the client loses mobility in the knee most often require surgery and extensive physical therapy to properly heal. The value of a patella fracture claim from a car accident is, in my experience, worth at least $25,000.00 if no surgery is required. This value of course can go much higher depending on the long term prognosis of the injury. The value of a patella fracture with surgery can easily exceed $100,000.00 once all medical bills and recovery costs are calculated.

  • FEMUR FRACTURES IN CAR ACCIDENTS

The large bone in the upper leg is the femur. Commonly referred to as the "thigh bone," this bone is incredibly strong. It is also the largest bone in the body. If a client comes into the office to discuss a femur injury, I almost immediately know that the injury was very serious and that, knowing the tendencies of the femur, the fracture was a compound fracture.

In mild fractures of the femur, casts and time will be the appropriate treatment. Serious fractures and compound fractures of the femur, will require major surgery. Usually, the surgery requires that a rod be inserted down the center or the femur to provide the stability. This surgery is done under general anesthesia and there will be permanent scaring. Compound femur fractures, even after maximum medical improvement, will involve long term  knee pain and arthritis. If sufficient insurance coverage is in place, a compound femur is worth in excess of $250,000.00.

  • OTHER FACTORS TO CONSIDER IN LEG FRACTURE CLAIMS

Serious leg fractures, whether in the upper or lower leg, can require plates and screws to stabilize the fracture. In the most severe fractures, doctors will use external rods, braces and attachments to stabilize the fracture and allow it to fuse properly. Fractures requiring external hardware for stabilization have significantly higher values because they are extremely painful and tend to lead to long-term arthritis. In cases with sufficient insurance coverage, external fixation fractures can be worth over $300,000.00.
